Welcome to TopCard (hereinafter referred to as “we”, “our”, “us”, or “Company”). By accessing or using the TopCard website, mobile applications, or related services (collectively referred to as the “Platform”), you agree to comply with and be bound by these Terms & Conditions (“Terms”).

If you do not agree with any part of these Terms, please discontinue use of the Platform immediately.


1. DEFINITIONS

“User” means any individual or entity accessing or using the Platform.

“Services” refers to digital payment facilitation services provided by TopCard, including but not limited to bill payments, mobile recharges, FASTag recharge, and other financial services.

“Content” means information, text, images, graphics, or other materials uploaded, downloaded, or appearing on the Platform.

“Third Parties” means entities outside the control of the Company, including banks, payment gateways, telecom providers, utility companies, and analytics providers.


2. ELIGIBILITY

You must be at least 18 years of age and legally capable of entering into binding contracts under applicable law to use the Platform.

By accessing or using TopCard, you represent and warrant that you meet these eligibility requirements.


3. ACCOUNT REGISTRATION

Certain services on the Platform require users to create an account.

By registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account details
  • Keep your login credentials confidential

You are responsible for all activities that occur under your account.


4. KYC AND DOCUMENTATION

To comply with applicable regulations, TopCard may require Know Your Customer (KYC) verification.

Users may be asked to provide:

  • Identity proof
  • Address proof
  • Mobile number verification
  • Other documentation as required by regulatory authorities

Accounts with incomplete or unverifiable KYC may be restricted or declined.


5. USE OF SERVICES

You agree to use the Platform only for lawful purposes.

You must not use TopCard for:

  • Fraudulent or illegal activities
  • Money laundering or financing unlawful activities
  • Attempting to hack, disrupt, or damage the Platform
  • Violating any applicable laws or regulations

Violation of these rules may result in account suspension or termination.


6. FEES AND CHARGES

TopCard may charge fees for certain services provided on the Platform.

These may include:

  • Service charges
  • Processing fees
  • Taxes required by law

All applicable charges will be communicated to users before completing a transaction.


7. TRANSACTION POLICIES

All transactions processed through the Platform are subject to verification and approval.

TopCard is not responsible for delays, failures, or reversals caused by:

  • Banks
  • Payment gateways
  • Telecom providers
  • Utility service providers
  • Technical issues beyond our control

Users must verify payment details before confirming any transaction.


8. REFUND & CANCELLATION POLICY

Once a transaction has been successfully completed, refunds are generally not permitted.

Refunds may be issued only in specific cases such as:

  • Failed transactions
  • Technical errors
  • Duplicate payments

Approved refunds will be processed within 7–10 business days, subject to verification.

TopCard reserves the right to deny refund requests in cases of misuse or fraudulent activity.


9. CONTENT AND INTELLECTUAL PROPERTY

All content available on the Platform, including:

  • Logos
  • Trademarks
  • Text
  • Graphics
  • Software
  • Website design

is the intellectual property of TopCard or its licensors and is protected under applicable intellectual property laws.

Users may not reproduce, distribute, or copy any material without written permission.


10. THIRD-PARTY LINKS

The Platform may contain links to third-party websites or services.

TopCard does not control or endorse these websites and is not responsible for their content, policies, or practices.

Accessing third-party services is done at your own risk.


11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, TopCard and its affiliates shall not be liable for:

  • Direct or indirect damages
  • Loss of data
  • Loss of income or profits
  • Service interruptions
  • Transaction failures caused by external providers

This limitation applies to all use of the Platform.


12. INDEMNIFICATION

You agree to indemnify and hold harmless TopCard, its directors, employees, partners, and affiliates from any claims, losses, damages, or expenses resulting from:

  • Your misuse of the Platform
  • Violation of these Terms
  • Violation of any applicable laws or third-party rights

13. PRIVACY POLICY

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

By using the Platform, you agree to the terms outlined in the Privacy Policy.


14. TERMINATION

TopCard reserves the right to suspend or terminate user accounts at any time if:

  • These Terms are violated
  • Fraudulent or suspicious activity is detected
  • Required by legal or regulatory authorities

Termination may occur with or without prior notice.


15. GOVERNING LAW & JURISDICTION

These Terms & Conditions are governed by the laws of India.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of courts located in India.


16. CHANGES TO TERMS

TopCard reserves the right to update or modify these Terms at any time.

Updated Terms will be published on the Platform along with the revised effective date.

Continued use of the Platform after changes indicates acceptance of the updated Terms.
